HOOP ATLAS is an analytical intelligence platform designed for certified sports agents, professional basketball clubs (EuroLeague, ACB, BBL, LNB, ABA Liga), and collegiate scouting departments. We process publicly available athletic performance metrics, official roster demographics, box scores, and media presser quotes.
Zero Health/Medical Data Processing Guarantee: HOOP ATLAS does NOT collect, store, or process private protected health information (PHI), electronic medical records (EHR/HIPAA), or confidential medical charts. All durability ratings are computed exclusively from publicly verifiable box scores (games played vs scheduled games) and public press conferences.
2. Lawful Basis for Processing (GDPR Art. 6 & Art. 85)
For individuals residing in the European Economic Area (EEA) and the United Kingdom:
- Legitimate Interests (Art. 6(1)(f) GDPR): Processing is necessary for legitimate commercial, analytical, and professional scouting purposes in facilitating international employment opportunities for athletes in professional basketball leagues.
- Freedom of Expression & Journalism (Art. 85 GDPR): High-level collegiate athletics is a matter of public athletic record and sports journalistic analysis.
3. United States Statutory Framework
- Copyright Law (17 U.S.C. § 102(b)): Under Feist v. Rural (1991) and NBA v. Motorola (1997), factual sports scores, statistics, and player biometrics are non-copyrightable facts in the public domain.
- CFAA (18 U.S.C. § 1030): In compliance with hiQ Labs v. LinkedIn (2022) and Van Buren v. US (2021), the platform accesses only publicly open web data without circumventing password gates.
- First Amendment Protection: Under C.B.C. Distribution v. MLBAM (2007), analytical reporting of athletic statistics is protected speech.
